Home Depot and Menards Law Suit

In another example where layers should be shot, and people are just plan idiots. These morons are attempting to sue Home Depot and Menards for false advertising of their 4x4 lumber. Who doesn't know that lumber is not actually the size it's called? I hope what ever judge gets this case throws it out. It is government-approved industry standard.

Also, why are they stopping with HD and Menards, why not sue Lowes, Do-it Lumber, Ace-hardware, and any other place that sells lumber? Damn lawyers.

But you know what is going to come out of this, there is going to be a new law created that manufactures/sellers have to put the actual specifications of the lumber. Just wait, it'll happen. So sad :((

Just a follow up on this, don't know about this case specifically but I have found 2 other cases regarding 4x4s that both judges dismissed. Yeah for some judges with common sense.

I'm guessing that some liberal judge will overturn the dismissal on appeal, eventually. Just needs to land on the right desk.

Kind of looks like that's whats happening, searching around I found at least 3 identical suits over the last 4 years. Looks like the key for the stores is the fact that the label just says 4x4, it does not say 4"x4". If the store ever puts inches on the labels they could be in trouble but as it stands the label says 4x4 which is simply just a name as far as the courts are concerned.
